1.   GLENDALE 10 SUBDIVISION GENERAL PLAN AMENDMENT AND REZONING GPA19-01 & ZON19-03A request by James Lee, Genica Group of Companies, to amend the General Plan on a 9.97-acre site from HDR 20 (High-Density Residential, 12-20 du/ac) to MDR 5 (Medium-Density Residential, 3.5-5 du/ac).
 
The applicant also seeks to rezone the property from R-4 (Multiple Residence) to R1-4 (Single Residence). The site is located at the southwest corner of Citrus Way and 67th  Avenue and is in the Ocotillo District.  Staff contact:  Jeremy Underwood, Planner (623) 930-2553.

2.   GLENDALE 10 SUBDIVISION PRELIMINARY PLAT PP19-01: A request by James Lee, Genica Group of Companies, for a preliminary plat known as “Glendale 10 Subdivision”. The proposal includes 47 single-family residential lots and 8 common area tracts on approximately 9.9 acres. 3.   75th AVENUE OFFICE SUITES GPA19-03 AND ZON19-09: A request by Jody Blais, Blais Properties LLC, for 1) a General Plan Amendment from LDR (Low Density Residential, 1-2.5 du/ac) to OFC (Offices); and 2) a to rezone from A-1 (Agricultural) to C-O (Commercial-Office) in order to develop a 9,600 square foot office building and associated parking area on 1.15 acres.  The site is located along the west side of 75th Avenue, approximately ¼ mile south of Deer Valley Road in the Cholla Council District (21360 North 75th Avenue).  Staff Contact:  George Gehlert, Planner at (623) 930-2597. 6.   BANK OF AMERICA DRIVE-UP ATM CUP19-02:  A request by Kacy Green, with Gensler Development, for a conditional use permit (CUP) which would allow the operation of a drive-up ATM. 7.   Faith Bible Church Classroom/Daycare Facility CUP19-08: A request by Tom Payton, Thomas A. Payton, Architect PLC, representing Faith Bible Church, for approval of a Conditional Use Permit for operation of a day care use in an SR-17 (Suburban/Residential) zone.  Approval of the request would establish a 5,000 square foot classroom type facility on the existing 8.9 acre Faith Bible Church property.  The site is located between 59th and 61st Avenues, approximately ¼ mile north of Bell Road in the Sahuaro Council District (17230 North 59th Avenue).  Staff Contact:  George Gehlert, Planner at (623) 930-2597. a.   This report allows the Staff of the Planning Division to update the Commission and the public. The Commission is prohibited from discussing or acting on any of the items presented by the Staff since they are not itemized on the Planning Commission Agenda.

Pursuant to A.R.S. 38-431(4), one or more members of the Planning Commission may be unable to attend the meeting in person and may participate telephonically.

In accordance with Title 38 of the Arizona Revised Statutes (A.R.S.), upon a public majority vote of a quorum of the Planning Commission, the Commission may hold an executive session, which will not be open to the public, regarding any item listed on the agenda but only for the following purposes:

 
(i)    discussion or consideration of records exempt by law from public inspection (A.R.S. 38-431.03(A)(2))
(ii)   discussion or consultation for legal advice with the city's attorneys (A.R.S. 38-431.03(A)(3))
(iii)  discussion or consultation with the city's attorneys regarding the city's position regarding contracts that are the subject of negotiations, in pending or contemplated litigation, or in settlement discussions conducted in order to avoid or resolved litigation (A.R.S. 38-431.03(A)(4))

Confidentiality requirements pursuant to A.R.S. 38-431.03(C)(D):  Any person receiving executive session information pursuant to A.R.S. 38-431.02 shall not disclose that information except to the Attorney General or County Attorney by agreement of the Planning Commission, or as otherwise ordered by a court of competent jurisdiction.
