4.   WITHDRAWALS AND CONTINUANCES
 
1.   STRUCTURED SOBER LIVING HOMES ZTA19-03:   A request by City of Glendale Planning Commission to amend various sections of the Zoning Code related to the definition of sober living homes and place controls on the number and location of such facilities in a manner consistent with Federal and State laws.  Sober living homes will be regulated similarly to other Group Homes in the Zoning Code.  The intent is to provide reasonable protections for neighboring residential properties while allowing such group homes as required by Federal Law.  City-wide. 5.   PUBLIC HEARING ITEMS
 
1.   83RD AND CAMELBACK RETAIL GPA19-05 AND ZON19-11:     A request by Eric Gerster, Sustainability Engineering Group, LLC, on behalf of  Barclay Group (Developer) to allow a General Plan Amendment from PC (Planned Commercial) to GC (General Commercial); and a rezone to change the existing zoning from SC (Shopping Center) to PAD (Planned Area Development) to develop approximately 11.3 acres of property as a commercial plaza that will allow more flexible commercial uses which will serve the needs of the community. 2.   BELL-53rd PAD ZONING PROPOSAL (ZON19-07):   A request by Ed Bull, Burch & Cracchiolo, on behalf of Bell 53rd LLC, to rezone an 8-acre property located at the southwest corner of Bell Road and 53rd Avenue.  The request would change the zoning from B-P (Business Park) to PAD (Planned Area Development). 3.   USAA DRIVE-UP ATM CUP19-09:  A request by Robert Jacknewitz, with Permit Consultants, on behalf of Glendale Center LLC, for a conditional use permit (CUP) that would allow the operation of a drive-up ATM. a.   This report allows the Staff of the Planning Division to update the Commission and the public. The Commission is prohibited from discussing or acting on any of the items presented by the Staff since they are not itemized on the Planning Commission Agenda.

Pursuant to A.R.S. 38-431(4), one or more members of the Planning Commission may be unable to attend the meeting in person and may participate telephonically.

In accordance with Title 38 of the Arizona Revised Statutes (A.R.S.), upon a public majority vote of a quorum of the Planning Commission, the Commission may hold an executive session, which will not be open to the public, regarding any item listed on the agenda but only for the following purposes:

 
(i)    discussion or consideration of records exempt by law from public inspection (A.R.S. 38-431.03(A)(2))
(ii)   discussion or consultation for legal advice with the city's attorneys (A.R.S. 38-431.03(A)(3))
(iii)  discussion or consultation with the city's attorneys regarding the city's position regarding contracts that are the subject of negotiations, in pending or contemplated litigation, or in settlement discussions conducted in order to avoid or resolved litigation (A.R.S. 38-431.03(A)(4))

Confidentiality requirements pursuant to A.R.S. 38-431.03(C)(D):  Any person receiving executive session information pursuant to A.R.S. 38-431.02 shall not disclose that information except to the Attorney General or County Attorney by agreement of the Planning Commission, or as otherwise ordered by a court of competent jurisdiction.
